These terms govern your use of the freelanddivision.com.au website. They are not the terms of any land division arrangement — that would be a separate written agreement.
1. About these terms
This website is operated by Curated Property Group Pty Ltd (ABN 87 678 826 429) ("we", "us", "our"). "Free Land Division" is a trading brand of that company.
By using this website you agree to these terms. If you do not agree with them, please do not use the site.
2. Who we are and what we are not
We partner with landowners to fund and manage land divisions in South Australia, and share in the value created.
We are not:
- A licensed real estate agent or land agent
- A licensed financial adviser or the holder of an Australian Financial Services Licence
- A mortgage broker or credit provider
- A registered tax agent or accountant
- A law practice
- A licensed surveyor, town planner or builder
Where a project requires any of those licensed services, we engage appropriately licensed professionals to provide them.
3. Not a financial or investment product
Curated Property Group Pty Ltd does not hold an Australian Financial Services Licence, an Australian Credit Licence, a land agent’s licence under the Land Agents Act 1994 (SA), or any other financial services or credit authorisation, and is not an authorised representative of any licensee. We do not act as your agent, representative, adviser, fiduciary or trustee. We deal with property owners in our own capacity and on our own account.
Nothing offered, described or referred to on this website is a security, an interest in a managed investment scheme, a derivative or any other financial product within the meaning of Chapter 7 of the Corporations Act 2001 (Cth), and nothing is credit under the National Consumer Credit Protection Act 2009 (Cth). You contribute no money, nothing is pooled with any other landowner or investor, and nothing on this website is a prospectus, product disclosure statement or offer document.

They do not by themselves determine how any arrangement is characterised at law, and you should obtain your own independent legal advice on the nature and effect of any agreement before you sign it.
4. The nature of the information on this site
The information on this website is general information only. It has been prepared without taking into account your objectives, financial situation or needs.
We have prepared it in good faith and taken reasonable care, but we do not warrant that it is complete, accurate, current or suitable for your circumstances. Planning rules, statutory fees, construction costs and property markets all change, and information that was accurate when published may not be accurate when you read it.
5. Financial figures, case studies and the calculator
This is important, so we have set it out plainly.
- Every dollar figure on this website is an illustrative example. The worked examples describe a hypothetical property. They do not describe an actual completed project and are not presented as a past result.
- They are not forecasts, projections, valuations, guarantees or offers.
- The calculator produces a rough indication only. It applies generalised cost assumptions modelled on typical South Australian projects to figures that you supply. It does not assess your actual property, does not know your planning zone, site conditions, services, trees or easements, and cannot tell you whether your land can be divided at all.
- All figures exclude GST and taxation, which can materially change the outcome and which depend on your circumstances.
- Actual results vary and may be materially different. No particular result is promised, represented or guaranteed. Some properties cannot be divided, and some divisions do not create enough value to be worth doing.
You should not make any decision about your property in reliance on the figures on this website. Obtain your own professional advice.
6. No offer and no advice
Nothing on this website constitutes financial, investment, legal, taxation, valuation or real estate advice, and nothing on it is an offer, invitation or recommendation to enter into any transaction.
Before entering into any arrangement with us, you should obtain independent legal advice, and independent advice from a registered tax agent or accountant, about your specific circumstances. We will always encourage you to do so.
Any land division partnership between us would be governed exclusively by a separate written agreement. If there is any inconsistency between that agreement and this website, the written agreement prevails.
7. Enquiries and your information
Submitting an enquiry does not create any obligation on either of us. It does not commit you to anything, and it does not commit us to assessing your property, making a proposal, or entering into any arrangement.
We handle the information you give us in accordance with our Privacy Policy. When you submit an enquiry you confirm that the information you have given is accurate, and that you are the owner of the property or are authorised by the owner to make the enquiry.
8. Acceptable use
You must not:
- Use this website for any unlawful purpose
- Submit false, misleading or fraudulent information through our forms
- Submit another person's details without their authority
- Attempt to gain unauthorised access to the site or any system connected to it
- Interfere with the operation of the site, or introduce malicious code
- Use automated means to scrape or harvest content or data from the site
9. Intellectual property
All content on this website — including text, layout, design, graphics, diagrams, the calculator and its underlying model, and the Free Land Division name and logo — is owned by or licensed to Curated Property Group Pty Ltd and is protected by copyright and other intellectual property laws.
You may view the site and print or download extracts for your own personal, non-commercial use. You must not otherwise reproduce, adapt, republish or commercially exploit any part of it without our prior written permission.
10. Third party links
This website may link to third party websites, including government and regulator sites. We provide those links for convenience. We do not control those sites, we are not responsible for their content, and a link does not imply endorsement.
11. Website availability
We do not guarantee that this website will be available at all times or free from errors or interruptions. We may change, suspend or withdraw the site, or any part of it, at any time without notice.
12. Liability and Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded or limited. Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited to resupplying the relevant services or paying the cost of having them resupplied.
Subject to the paragraph above, to the maximum extent permitted by law we are not liable for any loss or damage — including indirect or consequential loss, loss of profit, or loss of opportunity — arising from your use of, or reliance on, this website or any information on it.
13. Changes to these terms
We may change these terms from time to time. The current version is always available at this address, and the "last updated" date shows when it last changed. Your continued use of the site after a change means you accept the revised terms.
14. Governing law
These terms are governed by the laws of South Australia. You and we submit to the non-exclusive jurisdiction of the courts of South Australia and the courts that hear appeals from them.
